So the critical issues are one of due process and what criteria is
used for such a list.
Now I don't know Ernie's level of expertise nor his objectivity--but
when someone makes a list--rightly or wrongly it carries the
imprimator/cachet of the group--that was my impression. Now it seems
this is one persons assertion with some yet unknown standard with some
others jumping in to make assertions based on Ernie's loaded
solicitation.
Is the general consensus that Mr. Krumbein is at the level to make
such a list--and is the criteria and process is fair?
What is wrong is that he puts one on the list with nary a contact then
appears to fish for evidence by soliciting members to find fault after
the fact. And expectedly there is a bit of a free-for-all and
circle-the wagons to protect Ernie from the mean lawyer.
An old debate trick is make so many attacks that the attacked can not
reasonably respond to all--whereby the shameful finds his culpability.
One member asserted that the failure to include provenances is ipso
facto reason to be put on the list(s). Is this a reasonable
criterion? Does Ernie list every provenance?
As a consequence and in good faith, I have listed some of the
provenances of the doubtful items --all major dealers--easily verified.
But it is obvious this is an uphill battle. This site has a great
responsibility--I hope that there is some weight given to blacklisting
a person--for there can be abuse without reasonable safeguards.
Due process should be a minimal requirement.
Many have said the Egyptian item is a fake. Yet I bought it from a
major dealer--at a major show no less.
Whoever sanguinely asserted that the boat figure is fake--a modest
proposal--I will subject it to expert review by Caldwell and
Associates--and if it is determined that it is not conclusively fake
you pay me the $250 fee? Any takers call me--310-503-1267.
I thank those who have emailed with their support. Maybe this board
needs some reforms--vis a vis the blacklist process--irrespective of
whether it is actionable libel in California or whether it constitutes
the tort of interference with contract relationships.
